1. General Information and Platform Role

The information, services, and materials provided on or through the Curve.Book website and online platform (collectively, the "Platform") are intended solely for general informational and community book-swapping purposes. Curve.Book functions strictly as an online intermediary and digital venue that facilitates peer-to-peer book exchanges, swaps, and interactions between individual book lovers.

Curve.Book does not act as a seller, buyer, retailer, publisher, or distributor of books. We do not own, inspect, store, ship, or verify any of the books listed by users on the Platform. Any transaction, agreement, communication, or exchange of books is solely between the participating users. Consequently, Curve.Book is not a party to any contract, verbal or written, entered into between users of the Platform.

2. "As Is" and "As Available" Clause

The Platform, including all functionalities, software, user-generated content, book descriptions, and related services, is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law in the United States, Curve.Book makes no representations, warranties, or guarantees of any kind, whether express, implied, statutory, or otherwise, regarding the Platform or its contents.

We do not warrant that:

  • The Platform will operate uninterrupted, secure, or error-free at any particular time or location.
  • Any defects, bugs, or errors in the software or database will be corrected.
  • The Platform is free of viruses, malware, or other harmful components.
  • The results obtained from using the Platform will meet your specific requirements or expectations.

3. No Warranties and Condition of Books

Curve.Book expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.

Because the books offered for swap on the Platform are pre-owned and provided directly by individual users, Curve.Book cannot and does not guarantee, warrant, or represent:

  • The physical condition, cleanliness, or hygiene of any book exchanged (including, without limitation, the presence of allergens, dust, mold, mildew, tobacco smoke, pet dander, or pests such as booklice or bedbugs).
  • The completeness, accuracy, or authenticity of the book listings, including descriptions of wear and tear, missing pages, annotations, or signatures.
  • The legality or ownership of the books offered for exchange by users.
  • The safety, conduct, or identity of any user you choose to interact or meet with, whether online or in person, for the purpose of swapping books.

Users are encouraged to exercise caution, common sense, and due diligence when arranging swaps and inspecting books upon receipt.

4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Curve.Book, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with:

  • Your access to, use of, or inability to access or use the Platform.
  • Any conduct, interactions, disputes, or content of any third party or user on the Platform, whether online or offline.
  • Any physical injury, property damage, illness, or allergic reaction resulting from books received through the Platform.
  • Loss, theft, damage, or non-delivery of books during shipping, mailing, or hand-to-hand transit.
  • Unauthorized access, use, or alteration of your transmissions or personal data.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, Curve.Book’s liability shall be limited to the maximum extent permitted by law.

5. User-Generated Content and Third-Party Links

The Platform contains user-generated content, including book listings, reviews, comments, and user profiles. Curve.Book does not pre-screen, monitor, edit, or endorse user-generated content and is not responsible for any inaccurate, defamatory, offensive, or unlawful material posted by users. Any reliance you place on such information is strictly at your own risk.

Additionally, the Platform may feature links to external, third-party websites, shipping services, or digital tools. Curve.Book does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Curve.Book shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such external content, goods, or services.

6. Copyright and Intellectual Property Disclaimer

Curve.Book respects the intellectual property rights of others. Users are solely responsible for ensuring they have the right to upload any text, images, or book cover art to the Platform. If you believe that any material on the Platform infringes upon your copyright, please contact us in accordance with the Digital Millennium Copyright Act (DMCA) procedures. We will promptly review and, if appropriate, remove infringing content.

7. Indemnification

You agree to defend, indemnify, and hold harmless Curve.Book, its parent company, subsidiaries, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Platform, your violation of this Disclaimer or our Terms of Service, or your violation of any third-party rights, including copyright, property, or privacy rights.
